By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

GenCrafters provides users with a comprehensive platform to generate AI-powered images from text descriptions using state-of-the-art machine learning models including Flux Pro, Stable Diffusion, and other advanced AI technologies.

You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations. You are solely responsible for ensuring your use of generated content complies with all applicable laws.

User Accounts and Registration

1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process and keep this information updated.

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use.

3. Age Requirement: You must be at least 13 years old to use GenCrafters. If you are under 18, you must have parental consent.

4. API Keys: If you generate API keys, you are responsible for their security and all usage associated with them.

Content and Generated Images

Your Content

• You retain ownership of the text prompts you submit to GenCrafters.
• You are responsible for ensuring your prompts do not violate any third-party rights or applicable laws.

Generated Images

• Subject to your compliance with these Terms and applicable law, you own the images you generate using GenCrafters.
• You are granted a worldwide, royalty-free license to use, reproduce, modify, and distribute your generated images.
• We reserve the right to use generated images for service improvement, marketing, and AI model training unless you opt out.

Prohibited Content

You agree not to use GenCrafters to generate content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights of others
• Contains hate speech, harassment, or discrimination
• Depicts violence, gore, or illegal activities
• Contains sexually explicit content or nudity
• Impersonates real individuals without consent
• Is used for deceptive or fraudulent purposes
• Violates the rights of privacy or publicity of any person

We reserve the right to remove any content that violates these prohibitions and terminate accounts of repeat offenders.

Credits and Usage

1. Credit System: GenCrafters operates on a credit-based system. Each image generation consumes credits based on the model and resolution used.

2. Welcome Credits: New users receive a one-time grant of Welcome Credits on signup to explore the service. These credits are non-transferable and may expire after a period of inactivity.

3. Purchased Credits: Credits purchased through our platform are subject to the pricing terms in effect at the time of purchase.

4. No Refunds: All credit purchases are final and non-refundable unless otherwise required by law.

5. Credit Expiration: Welcome Credits may expire after a period of inactivity. Subscription credits roll over for up to 2 months. Credits from purchased credit packs do not expire.

Intellectual Property Rights

Our Rights

• All content, features, and functionality of GenCrafters, including but not limited to software, algorithms, AI models, user interface, and documentation, are owned by GenCrafters or its licensors.
• The GenCrafters name, logo, and trademarks are the property of GenCrafters.

Your Rights

• You retain all rights to the text prompts you submit.
• You own the generated images subject to these Terms.
• You may use generated images for personal or commercial purposes.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Reverse engineering, decompiling, or disassembling our service
• Attempting to bypass any security features or access restrictions
• Using automated scripts, bots, or scrapers to access the service
• Reselling or redistributing access to the service without authorization
• Interfering with or disrupting the security or performance of the service
• Using the service to generate content that violates our Prohibited Content policy
• Attempting to extract or download our AI models or underlying technology
• Sharing account credentials or API keys with unauthorized users

Privacy and Data Collection

GenCrafters collects the following types of data:

• Account Information: Information you provide when creating an account
• Generated Content: Text prompts and AI-generated images
• Usage Details: Data related to your activity, credit usage, and generation history
• Device Information: Information about the device you use to access our service
• Cookies: Data that helps us enhance your experience
• Payment Information: Data necessary to process payments (handled by Stripe)

Pricing and Payments

• Prices for credits and subscriptions are displayed on our pricing page and are subject to change with notice
• All purchases are processed securely through Stripe
• You agree to pay all charges associated with your selected plan
• Subscription plans automatically renew unless cancelled
• You may cancel your subscription at any time, and it will remain active until the end of the current billing period

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for:

• Violations of these Terms of Service
• Conduct that is harmful to other users, us, or third parties
• Failure to pay fees when due
• Extended periods of inactivity

Upon termination, your right to use the service will immediately cease, and you may lose access to your generated content and account data.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE.

Specifically, we do not warrant that:

• The service will meet your specific requirements
• The service will be uninterrupted, timely, secure, or error-free
• Generated images will be accurate, appropriate, or suitable for your intended use
• Any errors in the service will be corrected

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GENCRAFTERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or goodwill
• Costs of procurement of substitute goods or services
• Damages resulting from generated content
• Unauthorized access to or alteration of your transmissions or data

Indemnification

You agree to indemnify and hold harmless GenCrafters, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of a third party
• Content you generate or submit

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GenCrafters operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the service will first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with applicable laws.
